 AUCTION TERMS & CONDITIONS

The following "General Terms & Conditions" generally outline terms and conditions of our auctions.  Specific Terms and Conditiuons per each auction will be posted at the auction site and will be verbally reviewed by the Auctioneer prior to the start of the auction.

1. Complete payment is due the day of sale in Cash, Certified Check or Guaranteed Funds.
 
2. Company or personal check MUST be accompanied by a current bank letter guaranteeing payment to ROBBCO unless otherwise approved by the Auctioneer. 
 
3. Announcements made on the day of the sale supersede all previously advertised terms and conditions.
 
4. Auction inventory is subject to change without notice.  Please check this webpage for updates prior to coming to the auction.
 
5. Some pictures may not be the actual auction items.

6. All auction inventory is subject to prior sale.

7. All items in auction are sold AS IS - WHERE IS with no warranties expressed or implied.  Please take time to inspect item prior to bidding.

8.  Once the Auctioneer says "SOLD" - and you are the high bidder, the item is yours and you own the item unless otherwise indicated by the Auctioneer.  You are responsible for the item at that time.  Please watch your items.  Care, custody and control of the item passes to you at that time.  All auction items are expected to removed from auction site the day of sale - unless otherwise indicated by the Auctioneer.  No item may be removed from auction site until fully paid for.  Any auction items left abandoned at the auction site will be disposed. 

9.  It is the Auctioneer's discretion to accept any bid over the prior bid.  The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of the consignor/seller.  The Auctioneer's decision is final regarding any disputes among bidders.

10. Bidders will be identified by number, rather than by name.  Please hold up your bid card for identification when Auctioneer says "SOLD".  You will be responsible for all items charged to your bidder number.  The Auctioneer reserves the right to accept or reject any bid from a bidder whose conduct, actions, or comments are deemed not in the best interest of the auction, its consignors/sellers or bidders. 

11. These "Terms & Conditions" are general.  Specific "Terms & Conditions" will be posted at the auction site on the day of the auction and will be reviewed verbally by the Auctioneer at the start of the auction.

12.  It may be possible for the Auctioneer's staff to bid on auction items in their personal behalf.  The Auctioneer will clarify at the beginning of the auction.  Absentee bidding may be allowed.  The Auctioneer will verbally announce this at the beginning of the auction.  The Auctioneer's Absentee Bid Policy will be postd at the auction site.

13.  Robbco Auction Services, its Auctioneers and staff,  will not be held liable for any accidents,  personal injury or property damage sustained in connection with the auction.

14.  The Auctioneers are licensed with the Ohio Department of Agriculture and are either bonded in favor of the State of Ohio or participate in the Ohio Auctioneer Recovery Fund.

15.  Ohio sales tax may or may not be collected at the auction per Ohio law.  The Auctioneer will verbally announce this requirement, if applicable, at the beginning of the auction.

16.  Generally a "Buyers Premium" will be added to the sucessful bidder's purchase to cover adminstrative costs for the auction.  The Auctioneer will make an announcement at the beginning of the auction and applicable signs will be posted at the cashier station indicating the percentage amount.  Generally a 5% Buyers Premium is charged at all of our auctions.

GENERAL  AUCTION  FEES

    For the Seller, general auctions include industrial, commercial, personal, farm, and estate auctions. Fees will be negotiated between our Client/Seller/Consignor  and Robbco Auction Services based upon the situation at hand. Every auction will be documented with an auction contract which will stipulate all the necessary particulars required under Ohio law. Generally our fees will range from 10% to 30% depending on the auction site, items to be auctioned, volume of the items, complexity, staging, and organization efforts needed to properly organize, advertise and execute the sale. Every effort will be made to maximize the value of the sale for the benefit of our clients.

CLASSIC CAR AUCTION EVENT FEES

REGISTRATION FEE - PER VEHICLE ONLY $25.00

CAR REGISTRATION FEES:  Registration fee is per vehicle. Car consignment registration fees includes advertising on ROBBCO AUCTION SERVICE web site, one (1) show parking pass for display car, one (1) general parking pass, and free admission. Additional show parking passes are $10.00 each. Additional general parking passes are $5.00 each.

CAR AUCTION FEES - ALL VEHICLES 5%

CAR CONSIGNMENT FEES:  At closing of the sale, if we handle the proceeds of the sale per your auction contract, we will deduct 5% from the proceeds of the sale. If we do not handle the proceeds of the sale, then you will owe ROBBCO AUCTION SERVICES  5 % of the sale price. If your item does not sell, no auction fee will be charged.  If you sell your car after the auction is over and as a result of the interest generated from our auction, we ask that you pay the 5% fee on the honor system. Paid registration fee per specific vehicle will be credited toward the Car Auction Fee.

OTHER CAR AUCTION ITEM FEES:   Fees for all other auction items, like parts & pieces, other than whole vehicles will be 15% of the sales price. No registration fees will be charged for other auction items.

CAR & PARTS "BUYERS PREMIUM" FEES:   If you are the successful high bidder at one of our Classic Car  auctions, we will add 5% to your purchase as a Buyer’s Premium to help defray administrative costs of the auction. 

CAR VENDOR FEES:   Vendor spaces are available for $25. Each space is 10 X 10. Vendor spaces can be reserved ahead of time, but must be paid for prior to start of auction.

AIRCRAFT AUCTION TERMS & CONDITIONS

The following "Aircraft Term & Conditions" provide for a NO-RISK

auction transaction between Seller and Buyer. 

1. FREE AUCTION WEBSITE LISTING:  Robbco Auction Services provides Sellers with a free auction website listing for auction aircraft.  The duration of this free website listing is month-to-month as determined by Robbco Auction Services.  This listing includes pictures.  Robbco Auction Services advertises its webpage in several national aviation publications.
2. NO OBLIGATION AUCTION LISTING:  For Sellers, Robbco Auction Services provides for a NO-OBLIGATION listing.  If we can not manage to present the Seller with a bonified purchase agreement from a qualified Buyer, then we do not earn any fees.  PERIOD!
3. REFUNDABLE DEPOSIT:  The Buyer must place a REFUNDABLE deposit of 5% of the accepted high bid price with Robbco Auctions Services at the conclusion of the auction within 5 days.  This deposit will be credited at closing to the purchase price. Should the transaction not close, the deposit will be returned to the Buyer within 5 days.
4. 5% BUYER PREMIUM:  A 5% buyer premium will apply to the winning bid, will be added to the final purchase price and will be paid by the Buyer at closing. 
5. AOPA CLOSING:  This sale will be closed by AOPA Closing Services.  The fees for this service will be shared by Buyer and Seller equally.  Closing will be within 30 days from the end of the auction.
6. SALE CONTINGIENCIES/SUBJECT TO:
   
   a. Free and clear title passes to Buyer as determined by AOPA Closing Serices.
